Alibaba Pitches Diagnostic Tool to Europe in China Outreach Move

(Bloomberg) — Alibaba Group is offering Europe’s embattled health systems a cloud-based coronavirus diagnostic tool it says it has successfully tried in China’s hospitals.The move by billionaire co-founder Jack Ma’s technology giant comes amid a bigger push by China to promote its efforts to contain the pandemic that started in the city of Wuhan and was left undiagnosed for a few weeks before spreading to the rest of the world. The company said it presented its machine-learning software for chest scans to health-care representatives in France and Italy.Alibaba’s efforts come as China and its top technology companies step up their outreach in Europe, showcasing virus-diagnosis and analysis tools. Telecoms giant Huawei Technologies said it offered Italian hospitals video conferencing and wireless connectivity capabilities. Internet search engine Baidu is proposing an algorithm to analyze the virus’s biological structure.As Europe becomes the epicenter of the virus, Beijing’s diplomatic and material efforts in the fight against the outbreak coincide with what’s seen as an attempt by the Trump administration to distance itself from the region.“Alibaba and other private companies are enrolled by China’s government in its long term plan: show their ability to be an ally for Europe, and pass the message that the U.S. is failing to help them,” said Antoine Bondaz, a researcher at the Strategic Research Foundation in Paris.France wouldn’t refuse the help being offered, and that if Alibaba wanted to contribute to research and diagnosis it could be allowed to, a French government official said, declining to be named in line with internal policy. The health ministry said it hasn’t received a proposal from Alibaba, adding that the “techniques have not been validated.” The diagnostic tool is also seen as costly and time-consuming.Alibaba, which has been expanding its European footprint in the payments and retail sectors, claims its software, developed at its research center called Damo, can diagnose the COVID-19 virus quickly and with 96% accuracy. The company says it has tested the product in China on 5,000 patients.Artificial intelligence-powered scans have been increasingly used in hospitals, and companies like Alphabet Inc.’s Google have developed data-learning solutions to help doctors diagnose diseases like cancer.In Europe, no private company or research lab has come forward with a broad diagnosis solution so far. Atos SE, the big data and cybersecurity company, said it has offered computing capabilities to reproduce and model the 3D atomic structure of the virus to labs in Spain and France.In the U.S., Alphabet Inc.’s health-care unit Verily ran tests for about 20 people on its first day screening the virus on Tuesday in California. Verily is a questionnaire-based diagnostic tool. Potential patients answer questions to determine if they need testing and are then redirected when required to Verily’s two testing sites where another sample is taken, Bloomberg reported.Meanwhile, in Italy, Huawei said it donated hospitals in Milan protective suits and 200,000 masks. Google critics see its Firebase tools as another squeeze play

Some app developers say Alphabet Inc’s Google is increasingly pressing them to embed code in their own products that will deepen Google’s access to data on consumers, giving the company a leg up on rivals. The previously unreported concerns about Firebase, a set of software that Google makes available to apps, have become part of the broad investigations launched last summer by state attorneys general and the United States Department of Justice into whether Google has unlawfully stifled competition in online advertising and other businesses, two people with knowledge of the probes said this month. Google declined to comment beyond generally describing Firebase tools as optional, usable in tandem with competing services and potential revenue-boosters for apps.

Google Agrees to Worker Council in Europe Amid Recurring Discord

(Bloomberg) — Google employees in Europe could soon have more power to challenge company decisions after the search giant approved the creation of a council that will represent the interests of thousands of its workers across the continent.Earlier this month, a group of 153 Google employees from 11 European offices wrote to the company’s management requesting the establishment of the council, according to three people familiar with the matter. Last week, Google’s management agreed to take the first steps toward creating the council and will soon begin negotiating with employees about its scope, the people said.The creation of such works councils— which aim to give employees the right to be consulted by management about issues such as organizational changes or job cuts — is required by the European Union if enough of a company’s employees in at least two countries file a written request.The works council is likely to include employee representatives from more than 35 Google offices across Europe, according to the people familiar with the matter. It will meet several times annually in Dublin, the people said.A spokeswoman for Alphabet Inc.’s Google said in a statement that the company had “always encouraged constructive and open dialog with Googlers, and we always will.”She added, “We look forward to working together with our employees on this.”The move could represent an opportunity for Google and its European employees to improve relations that in recent years have frayed over working conditions and decisions made by senior leadership at the company. In the last two years, the search giant has endured a series of internal protests as employees have complained about controversial contracts with the U.S. military, a plan to build a censored search engine in China and multimillion dollar payments to executives accused of sexual harassment.“The point of the works council is to be the voice of the employees — to express concerns and to find better solutions,” said Gabriel Kerneis, a Google software engineer who is based in Paris and was involved with the effort to set up the council. “We hope that it will create a fairer process.”The works council can’t veto company decisions, but the process means that employees should be consulted and can sometimes cast a vote to oppose or approve certain measures, allowing for greater input into management plans before they are finalized, said Kerneis.Google already has a works council in place in Paris, as mandated by French law. A similar council is currently being set up by employees in the company’s Zurich office, according to a person familiar with developments there. However, the nation-level councils can only consider issues relevant to their respective offices.Last year, employees who were involved in organizing internal protests at Google alleged that the company had retaliated against them, demoting them from their positions and effectively forcing them to leave the company. The search giant was also accused of developing an internal spy tool to monitor worker activism and of trying to shut down workers’ attempts to learn about their rights in Zurich. Google has denied allegations that it has sought to suppress employee activism.After those incidents, employees who were involved in trying to establish the European works council said that they were concerned that their efforts to gather support would be met with a harsh response from senior leadership, who they feared might try to shut them down.In the end, employees were pleasantly surprised by the positive response they say they received from company management, according to several employees.“We didn’t know what would happen, but there’s not been any blow back so far, which has been great,” said Hannah Pascal, a senior software engineer at Google who is based in London and was involved with the effort to set up the council. “These issues that are coming up — complaining about retaliation, or taking on dodgy contracts — we hope the council is going to allow us to have more of an eye-level discussion with management about them.”There is a legal mandate in the E.U. for the creation of works councils. A 2009 directive states that if a group of 100 employees from offices in two or more E.U. countries submit a written request for the establishment of a works council, central management must initiate negotiations to form one.Other large American technology companies, including Oracle Corp., HP Inc. and Dell Technologies Inc., have similar works councils in place in Europe. The results have been mixed. Twitter Escalates Moderation of Misleading Content Around Virus

(Bloomberg) — Twitter Inc. said on Wednesday that it’s expanding its content moderation rules to capture more forms of misinformation around the novel coronavirus, following a similar escalation of measures from Facebook Inc. earlier in the day.The company will require users to remove tweets that deny expert guidance, encourage fake or ineffective treatments and preventions or falsely purport to be from experts or authorities. The goal is to capture anything “that increases the chance that someone contracts or transmits the virus,” it tweeted. Twitter will also take action against claims alleging that particular groups or nationalities are more susceptible to Covid-19, calling out anyone suggesting that Chinese people are more likely to have the disease.For its part, Facebook is putting a Covid-19 information page at the top of users’ feeds and disseminating verified material from trusted sources such as the World Health Organization. The two social media giants are focal points for discussion of the issue, which spans the spectrum from helpful and informative to harmful and malicious.Twitter has historically been reluctant to remove or censor tweets and it continues to use similar language, calling its measures an effort to “protect the conversation.” But the company is now broadening its definition of harm to include more categories of potentially misleading content and act upon them. Google оплатил назначенный ФАС штраф в размере 438 млн рублей

Федеральная антимонопольная служба (ФАС) России сообщила об уплате административного штрафа в размере 438 млн руб. корпорацией Google Inc. Об этом сообщается на сайте ведомства.

«Мы уверены, что исполнение условий мирового соглашения обеспечит возможность развития конкуренции на рынке мобильного ПО в России, что благоприятно скажется на наших потребителях», — заявил заместитель руководителя ФАС России Алексей Доценко.

По его словам, закон о защите конкуренции необходимо соблюдать всем компаниям, продукция которых поставляется на территорию России, в том числе транснациональным корпорациям.

В апреле ФАС и Google заключили мировое соглашение.

В сентябре 2020 года ФАС России признала Google нарушившим ч. 1 ст. 10 закона о защите конкуренции (злоупотребление доминирующим положением).

ФАС установила нарушение в действиях Google, которые приводили к запрету на предустановку конкурирующих приложений других разработчиков. В результате из-за отказов другим производителям мобильных устройств самый эффективный канал распространения приложений — предустановка — оказался полностью зарезервирован за Google.

Google оплатила штраф

9 мая 2020 года корпорация Google Inc. оплатила административный штраф в размере 438 млн 067 400 рублей, назначенный Федеральной антимонопольной службой (ФАС России).

Ранее, 17 апреля 2020 года, в Арбитражном суде Московского округа мировым соглашением завершилось двухлетнее разбирательство между Федеральной антимонопольной службой и корпорацией Google. В рамках мирового соглашения удалось найти механизм устранения последствий, ранее выявленных ФАС России нарушений антимонопольного законодательства и обеспечить конкуренцию на рынках мобильных приложений, в первую очередь, мобильного поиска.

Напомним, что в сентябре 2020 года ФАС России признала Google нарушившим часть 1 статьи 10 Закона о защите конкуренции (злоупотребление доминирующим положением).

ФАС России установила нарушение в действиях Google, которые приводили к запрету на предустановку конкурирующих приложений других разработчиков. В результате, из-за отказов другим производителям мобильных устройств, самый эффективный канал распространения приложений – предустановка – оказался полностью зарезервирован за Google.

Кроме того, нарушение выразилось в предоставлении контрагентам – производителям мобильных устройств, предназначенных для продажи в РФ, – магазина приложений Google Play на определенных условиях. К ним относятся обязательная предустановка вместе с Google Play ряда других приложений компании, их размещение в приоритетных местах на экране, обязательная установка поисковика Google «по умолчанию».

«Мы уверены, что исполнение условий мирового обеспечит возможность для развития конкуренции на рынке мобильного ПО в России, что благоприятно скажется на наших потребителях. Закон о защите конкуренции необходимо соблюдать всем компаниям, продукция которых поставляется на территорию Российской Федерации – и транснациональным корпорациям в том числе», — отметил заместитель руководителя ФАС России Алексей Доценко.
